GENERAL TERMS AND CONDITIONS FOR CAR HIRE

Alfa Service S.R.L. (Followed by “Alfa Service”) hire to the customer the motor vehicle. Identified with special conditions in the present car hire contract, to the present car hire contract, to the agreements therein scheduled, more over to expiry and conditions:

_ Art. 1  

1. The customer has to note in good time the eventual anomalies of the vehicle not pointed out from Alfa Service at the time of delivery to the customer.Such as pointing out to the customer that in the event of a break down highlighted in the accompanying letter to the contract. Failing, assuming the customer has received the vehicle in perfect condition the customer has a duty to return the vehicle in the same condition, with the exception of the normal wear and tear of the tyres the distances covered the whole equipment, the documents issued. The vehicle will be returned to the Alfa Service office during opening hours in the city where the hire was taken in a different place and on the day specified in the present hire contract where the vehicle is used in violation of the arrangements of it foreseen. The present contract can be solved beforehand the Alfa Service, according to the law 1456 c.c. in case of the violation on the part of the customer of articles 2 or 3 of the present agreement, in case of bankruptcy or other concurrent proceedings at the expense of the customer.
In any case Alfa Service upon a written communication by registered letter reserves the right to resolve the present car hire contract and the eventual business agreement where it exists, if there are cut in the requirements according to the financial position of the costumer in which the assumption of these are funded on frozen agreements, the resolution is issued beforehand of the contract, the customer has to assure the return of the vehicle, property of Alfa Service and to comply to the due agreement until the date of delivery of the vehicle.
Apart from the subscription of the covering insurance according to the following law (art.6) the costumer will be responsible for damages to the vehicle, improper use or in relation to the kilometres covered even less of the commercial value, in case of theft, does not return the car keys, Alfa Service will not be responsible for damages as a result of failing to carry out on part of the costumer’s duties the maintenance, condition of the vehicle

2. The vehicle abroad can only be driven by the titleholder of the present car hire contract. In Italy the vehicle can only be driven by the customer, or by his employer, or by one of his employees of the same company of the customer. The vehicle can be driven from other persons whit the official sanctions written by payment indicated in present contract. On no condition can the vehicle be driven by persons without a valid driving licence and issued at least a year to adults under 23. Furthermore the vehicle must not be driven by persons drunk or under the influence of drugs, or certain medication.

Finally the vehicle must not be used:

a) For transport of smuggled goods, explosive material, toxic or for any other transport in violation of the laws or regulations;
b) To push or tow another vehicle or trailer;
c) In competitions of any sort, sport or non sport, or trying out long distances;
d) Start driving lessons or practising on part of the customer,
e) For any another use in violation of laws and regulations.

3. The customer has a duty to pay and/or reimburse Alfa Service his bill in the following ways:
a) The kilometres covered by the vehicle, calculate at the applicable tariff.
b) The due tariff in relation to the duration of the car hire. In case of late delivery over 59 minutes Alfa Service is authorised to invoice another day of hire;
c) An additional condition in which the vehicle is returned to a different Alfa Service station from the one where it was originally hired and the contract was made out;
d) Every other amount expected from the present contract and/or reimbursements including the additional charges expected for the exclusion of responsible for damages or theft;
e) The cost of refuelling in which the customer chooses to return the vehicle with the inferior amount of petrol to the amount he originally received.
f) On top of the charges for motorway offences made out to the customer and/or to Alfa service for violations of the highway code or other infringements of rules committed during the hire.
g) Any other charges to the motorway tolls not paid by the customer, the customer will be directly responsible for penalty sanctions imposed by the authorities apart from violation of the highway code or any other regulation applicable that are not chargeable to the customer in case of confiscation or any other time the is not in use. Alfa Service will charge the customer the fixed daily tariff for each day the vehicle is not in use;
h) Every expense including those legal, that Alfa service have to maintain to obtain the payments due from the customer;
i) All the administrative costs, added taxes as a result from the hire;
j) Compensation for damages, due to negligence, to the roof, windows, road bumpers, wheels, body parts, upholstery, loss of car keys, acts of vandalism, even if the customer has agreed to a premium for a discount, or rather the removal of the franchise. The customer has to note that the car hire will end on the date and time the vehicle is returned and the relevant car keys from Alfa Service. And if it is not redelivered on the written day and time an additional charge of €150,00 will be added. Furthermore in which case if the redelivery is made during office closing hours when the hire has ended then there is no charges added as soon as the office re-opens.

The costumer has a duty to contact Alfa Service within 2 days, of any statement made from authorities, the customer will be responsible for any damages affected by Alfa Service, directly or indirectly in any such delay on part of the customer.

_ Art. 5 DOWNLOAD | Condizioni Generali
The customer is responsible for the damages or theft of parts or the whole car up to the competition of the franchise indicated on the present contract. The customer has a duty to subscribe to the CDW additional services which reduces the franchise for which it makes it responsible in case of damages to the vehicle or to accept the Kasco (sko) which totally removes the franchise in the following groups (B/C/D/E/F/J/H/X) and reduced the present franchise in the following groups (/L/N/P/Q/R/S/Z/Prestige). On top of the reduced franchise CDW is specified in the general terms and conditions shown at the Alfa Service station. The (SKO) covering subscription is optional, it does not exempt the customer in the maintenance of the vehicle. Alfa Service reserves the right to proceed to sue the customer for any damages as a result from fraud or fault on part of the customer pledges to pay charges due as requested by Alfa Service. In case of accidents caused by the customer or without indication by the opposite party he/she will be charged €50,00 for administration costs for the accident. In case of an accident other than to the above stated franchise the customer will be charged the replacement of the safety airbags. The customer has a duty also to subscribe to the TP covering subscription for the reduction of theft franchise. It is optional to have the superkasco (STP) covering subscription for the total removal of such a franchise in the followings groups (B/C/D/E/F/J/H/X) and current franchise reduction in the groups (A/L/N/P/Q/R/S/Z Prestige). On top of the reduced franchise TP is specified in the general terms and conditions shown  at Alfa Service offices. The covering insurance subscription TP/STP does not exempt the customer to foster the maintenance or the prevention of theft of the vehicle.
Alfa Service reserves the right to charge the value of the vehicle (referring to euro tax), even having subscribed to the covering insurance STP, in case of a confirmation of theft, also fraud or serious fault of the customer, no redelivery of the car keys; however the customer pledges to pay such an amount as requested by Alfa Service.The general terms and conditions of the policy at the customer’s disposal until the customer can examine the contents. It is forbidden to drive in the countries not stated in the present contract and on the green insurance card, no covering insurance in the countries not mentioned in the car hire contract. However the customer will be wholly responsible of the damage or the theft that occur in these countries not covered.

_ Art. 6 DOWNLOAD | Condizioni Generali
The customer and any other person authorised to drive according to regulation (art.2) are covered by the vehicle insurance policy that expects the citizen’s responsibility towards third party insurance, such as damages to animals or things in the limits prescribed by the laws and applicable rules.Furthermore, the customer can subscribe to the optional insurances and services indicated in the present car hire contract, for which it also mentions the daily premium. The general terms and conditions of policy are at the customer’s disposal, until he can examine the contents.

_ Art. 7 DOWNLOAD | Condizioni Generali

In case of accidents, the customer can receive another vehicle from Alfa Service, (according to availability). In any case the customer has a duty to protect the interests of Alfa Service and its insurance company compelling him/her also to:
(a)Provide names and addresses of the parties involved and the witnesses of the accidents;
(b)To not admit eventual responsibilities or blame of which it is not certain;
(c)To not leave the vehicle unguarded or without eventual protection;
(d)To give the immediate news of the accident to the nearest Alfa Service office, even of slight damages, sending in a detailed report supplied in a diagram. According to laws 1913 c.c. and of L.26 February 1977, n.39, the customer has the duty to report the accident to Alfa Service by means of a one sided report or rather a friendly confirmation form of an accident signed by the drivers involved in the accident within 3 days to check the same accident. The non-compliance and written duty of the customer, puts in operation the additional CDW and KASCO of these last written below.
(e)To immediately inform the police authority if there are the third party’s accusations because of injured individuals.
Alfa Service does not guarantee in any case replacement of goods vans and expatriation is absolutely forbidden except for the stated authorisation from the car hire station.

The customer has to be aware that Alfa Service can never be responsible for losses or damages of items transported, abandoned or forgotten in the vehicle either during the hire or after the return of the vehicle, except for reported cases punishable to fraud  or serious faults from Alfa Service.

The remaining terms, the car manufacturer’s responsibility for the flaws in manufacture as Stated in the law (article 1) of the present contract, Alfa Service will use normal maintenance To maintain the vehicle fully efficient. If there are reports of breakdowns during the period of  hire. Alfa Service will not be responsible for damages of any kind, contractual or extra contractual suffered from the customer due to the above-stated breakdowns indirectly or Directly, except that the incidents chargeable to Alfa Service. However Alfa Service will not be Responsible for damages resulting from lack of attention and care on the part of the customer.

The customer also has a duty to not give up, sell, take money, give as security the present Contract, the vehicle, the equipment and his/her other duties and in any case he or she is not to Behave inappropriately to Alfa Service property rights.

Any differences or added terms to the present car hire contract, will only be valid if carried out In writing.

_ Art. 12 DOWNLOAD | Condizioni Generali

The present  car hire contract is regulated by the Italian law.

_ Art. 13 DOWNLOAD | Condizioni Generali

In case of disagreement of the interpretation between the Italian version and the requested Translation, of the present car hire contract, the Italian version will prevail over the others.

_ Art. 14 DOWNLOAD | Condizioni Generali

If  the customer intends to extend the car hire contract, other than the expiry stated in the Special conditions of the present car hire contract, he/she has to immediately contact the car hiring station to obtain the authorisation to the extension to the same contract. The customerAlso has to pay special attention to the agreements and terms established in the present car hire contract. Even if Alfa Service has authorised the extension to the car hire period.

_ Art. 15 DOWNLOAD | Condizioni Generali

Alfa Service will put on the bill(invoice) the scheduled services of the car hire contract to the Same subscriber, unless these contradict the car hire in name or of another subject for that properly authorised. In this case, such a different subject has to be indicated in the car hire Contract at the time of subscription.

The customer has been informed from Alfa Service that according to law D.lgs 30 June 2003, n196 (as mentioned in the privacy law) the information from the customer can be subject to the above-mentioned law, the person in question, subject to the “privacy law” is Alfa Service S.r.l. Via P. Toselli n25-95129 Catania. Such information will be used in the financial objectives of Alfa Service in which:

(1) The termination and the performance of a car hire contract and attached final contracts, Furthermore the bank details given so as to;
(2) put into effect the standard International payment systems (for example, cheques, by means of authorised credit cards, debit. ecc.);
(3) Delivering advertising material and the use of such material for commercial surveys and spending habits. Furthermore the details may be used by Alfa Service in the end to allow the
Authorities to send on the relevant objections to the customer responsible for violation of the highway code or any other applicable regulations, in order the relevant penalties are paid by
the customer.
In conclusion the details may be used by Alfa Service, according to law (Art .24) for any authorised activity from the stated provisions or guarantor’s provisions for the protection of personal details.

_ Art. 17 DOWNLOAD | Condizioni Generali

In case of a provision from the present car hire contract which would be null and void such nullity does not influence the invalidity of other provisions of the present car hire contract.

_ Art. 18 DOWNLOAD | Condizioni Generali
For any dispute between parties, about the present car hire contract it would be settled by the competent law court in Catania.
